HCAI CORPORATION , a limited liability company, registered with Employer Identification Number (EIN): 862312227, 3905 PRENTICE LN*AUSTIN*TX*78746, offers a technological platform through which it is possible to recruit candidates for job vacancies, by bringing employees and employers closer to them, according to the profile of candidates and available vacancies ("Services").
The services are provided through the jobs.levee.com and app.levee.com, anAndroid application called "Connected Employment", a digital platform called "LEVEE Workforce Solutions", or via SMS, WhatsApp, e-mail, among other communication channels.
These Terms and Conditions of Use in conjunction with our set out the terms and conditions applicable to the use of the Services that will be provided by HCAI tousers.
It is very important that any user read sand understands these rules, as well as other rules that may apply. By using our Services, you assume and expressly agree to these Terms and Conditions of Use.
You can browse part of the Website and/or app without being registered with the user account, in which case the General Conditions will apply (Part I below).
If the user (in this case "You" or "User") uses the Services provided through the Website, the App and/or the Communication Channels, he is expressly agreeing and agreeing to the Additional Terms and Conditions (Part II below).
These Terms and Conditions of Use may change at any time and the user will be informed in advance if this happens. If you do not agree to any changes made to these terms, we recommend that you stop using the Services. If you do not discontinue use of the Services, these Terms and Conditions of Use will be considered accepted.

Please note that such changes will apply to the Services provided to the User from the moment they are made available on the Website, App and or Digital Platform. Some conditions available in legal notices elsewhere on the Website, App and or Digital Platform. may replace or supplement these Terms and Conditions of Use, provided that expressly provided in each case.
Anyone using our Services, which includes simply visiting the Website, App and Or Digital Platform, as well as contact through the Communication Channels, assumes and expressly agrees to these Terms and Conditions of Use.
1.1. The Services are intended for: (i) capable individuals who are looking for job opportunities ("User-Candidate"); and, (ii) legal entities offering employment opportunities ("User-Employer"). The User-Candidate and the User-Employer, when referred to jointly, are simply referred to as Users for the purposes of these Terms and Conditions of Use.
2. Availability of Services
2.1. HCAI will make its best efforts to ensure the greatest possible availability of its Services. However, HCAI is not responsible for any unavailability of the Website, the App, Digital Platoform, the Communication Channels or any of its Services for any period or time.
2.2. Access to the Services may be interrupted, suspended or temporarily intermittent, without any prior notice, in case of system or server failure, maintenance, system change or for any reason that escapes HCAI's control, without proper repair by HCAI.
3.1. HCAI will endeavor to keep the content of the Website, the App, the Digital Platform, the Communication Channels up to date and complete, free of any defects or viruses. However, HCAI is not responsible for these and other potential problems. HCAI may change the content of the Website, App, Digital Platform or Communication Channels that it has at any time without notice.
3.2. Part of the information available on the Website, the App, the Digital Platform and/or Communication Channels is generated and transmitted by third parties, without HCAI's involvement or responsibility.
3.3. The User agrees to use the Services in good faith, without using, uploading, transmitting or sending from the Website, the App or the Communication Channels or for any material:
(a) that is of a violent or threatening, defamatory, obscene, offensive, pornographic, abusive nature, which may incite any form of racial, discriminatory or in violation of the privacy of a third party;
(b) for which all necessary licenses or approvals have not been obtained by the User;
(c) that constitutes or incites conduct that may be considered criminal or civil unlawful, that violates the rights of third parties either in Brazil or abroad or that are merely illegal in any other form;
(d) that are technically harmful, including, but not limited to, computer viruses, macros, "Trojan horses", worms, malicious components, corrupted data, and other malicious computer programs or data that are designed to interfere with, disrupt, or disrupt the normal operations of a computer; And
(e) that aims to defraud, conceal or compromise users' choice regarding the contracting of the Services, whether by creating false profiles, breaching security protocols or any other means.
3.4. Users must ensure that the use of the Services is not detrimental to the stability and availability of the Website, App or Communication Channels. If this occurs, the User in question may be liable for the damages to which it causes.
3.5. HCAI may be required to cooperate with authorities and with legal proceedings aimed at identifying Users who act in breach of the provisions of this item in which case it will cooperate.
3.6. HCAI may, at any time and in its sole discretion, add or remove content and functionality from the Website, the App and/or the Communication Channels without this characterizing, in any form, an offense to the rights acquired by users.
4. Intellectual Property Rights
4.1. The commercial use of the names, drawings and expressions "Related Employment", "jobs.levee.com", "LEVEE" and "app.levee.com", "levee.com" as business names, trademarks or domain names, as well as the contents of the screens relating to the Services as well as the programs, databases, documents and other utilities and applications are the property of HCAI and are protected by all applicable laws and treaties.
4.2. Misuse and reproduction in whole or in part of the contents referred to in Item 4.1 above are prohibited. If you wish to use any of this content, the User must contact us before doing so. Using any content mentioned herein without HCAI's prior and express permission may result in criminal and civil liability.
5.1. The Website, App or Communication Channels may contain links to other websites and Internet features, without this meaning that these websites are owned or operated by HCAI.
5.2. HCAI will not be responsible for the contents, practices and services offered by these websites, and the use of these is at the risk of each User.
5.3. The provision of links to other websites does not imply in relation to company, supervision, joint venture, solidarity or guarantee of HCAI towards these websites and their contents.
8. Other Conditions
8.1. HCAI is a company incorporated in Brazil and the Website and its Services are created and maintained in faithful compliance with Brazilian laws and other treaties that are incorporated into the Brazilian jurisdiction. If the User is enjoying access to the Services outside Brazil, the User will be responsible for compliance with local laws to the extent applicable.
8.2. If HCAI ceases to exercise any right provided for in these Terms and Conditions of Use, this shall not be construed as a waiver, waiver or revocation of the provision contained in these Terms and Conditions of Use.
8.3. All items of these Terms and Conditions of Use shall be governed by the laws in force of the Federative Republic of Brazil. To resolve any controversies is elected the Forum of the City of São Paulo, in the State of São Paulo, except for complaints submitted by Users that fit the legal concept of consumers, who may submit their complaints that do not find a friendly solution to the forum of the city in which they are rooted, according to article 101, I of the Consumer Protection Code.

Additional Terms and Conditions for Users
When the User uses the Website, App, Digital Platform and/or Communication Channels to apply for and/or disclose vacancies, these Additional Terms and Conditions must be observed.
10. About HCAI
10.1. HCAI, for only providing an online platform for job advertisements, has no responsibility for the advertised vacancies and/or for users who apply for or disclose vacancies through the Website, App and or Digital Platform.
10.2. No natural or legal person other than HCAI is authorized to charge any fee on HCAI's behalf.
11.Conditions Applicable to Services
11.1 Record and Registration
11.1.1. To access the Services, the User must register through the Website or the App, providing his/her personal information.
11.1.2. The User's registration is personal and non-transferable.
11.1.4. The User acknowledges and agrees that HCAI may also disclose the information made available by him/her to third parties in an anonymized manner, without expressly identifying them.
11.1.5. HCAI employs the best practices in the market to ensure the security of the User's registration, however, the confidentiality and security of the password for access to the Website and the App is the sole and exclusive responsibility of the User.
11.1.6. When the User registers on the Website or the App, the User attests that all the data provided are true, complete and accurate.
11.1.7. Providing incomplete, inaccurate or false information constitutes a violation of the duties of these Terms and Conditions of Use, and the User is entirely responsible for the damages to which such violation causes.
11.1.8. HCAI may need more information and documents about the User at any time, either to better identify him or to conduct internal due diligence, in which case the User will be required to provide them. Not promptly providing such information and documents when requested will constitute a violation of these Terms and Conditions of Use.
11.1.9. In addition to the foregoing, the User acknowledges that HCAI may obtain information from the User through business partners, other companies, government databases, social networks or public areas on other websites.
11.1.10. HCAI may use all lawful ways to verify, at any time, whether the information provided by the User is true.
11.1.11. If HCAI finds at any time, automatically or manually, that the information is in any way incomplete, inaccurate or false, the User may have his account suspended or cancelled, at HCAI's sole discretion, without prejudice to other measures that apply.
11.1.12. The information that the User uses to complete the registration may change, and the User undertakes to keep it always updated, requesting their change to HCAI as soon as there is any modification.
11.1.13. The request to change user registration data must be sent directly to HCAI through the Call Center.
11.2.1. After registering on the Website and/or the App, the User may apply directly with employers for available vacancies that have interest and / or disclose vacancies, as the case may be.
11.2.2. In addition, HCAI's platform will also automatically verify with Users-Employers the compatibility of The Candidate Users with the available vacancies.
11.2.3. In addition, Candidate Users who have met the requirements to receive job offers may receive free invitations to interviews or work each time a company wants to contact them for a vacant position.
11.2.4. The scheduling of job interviews may be carried out: (i) by cell phone, via SMS message or via instant messaging applications, such as, but without any limitation, WhatsApp and Facebook Messenger, if expressly authorized in registration by the User; (ii) through the App, including through push or in-app notification; (iii) through the Website; and/or (iv) through the e-mail registered by the User.
11.2.5. Until the confirmation of the interview by the employer, the User-Candidate may request from HCAI, at no cost, the cancellation of his application. In this case, the User-Candidate must send the request directly to HCAI through the Call Center.
11.3.1. Some data and information related to the vacancies advertised on the Website and/or the App are provided by Users- Employers without any involvement of HCAI. HCAI shall not be responsible for the veracity and completeness of such data and information provided by the Employer User for disclosure.
11.3.2. After scheduling an interview using HCAI Services, HCAI may allow the User-Candidate to access information relating to Users-Employers, such as name, address and other information, provided that it is expressly authorized by The Employer Users. The User-Candidate expressly acknowledges that such information is provided by Users-Employers, without any involvement of HCAI.
11.3.3. Without prejudice to any preliminary tests that may be applied by HCAI, Users expressly acknowledge that HCAI is not and will not be responsible for any monitoring or supervision of the practices and policies adopted for the recruitment, selection or hiring of the User-Candidate by the User-Employer.
11.3.4. The information and notices offered by HCAI to the User-Candidate regarding changes in the general characteristics of the vacancies (e.g. change of venue, schedule, remuneration and other characteristics linked to the vacancies) must always be confirmed by such User. HCAI has no obligation to offer the User-Candidate such information, and may do so by mere liberality.
11.3.5. HCAI has no obligation to notify the changes mentioned in the previous item, and it is always recommended that the Candidate User consult from time to time any changes in the description of the vacancies advertised on the Website, the App and/or the Communication Channels.
11.4. User Rights and Obligations
11.4.1. Users acknowledge and agree that they will be solely responsible for the form, content and accuracy of any curriculum and/or vacancy that is made available on the Website, the App and/or the Communication Channels. Likewise, Users are solely responsible for their posts on the Website, the App and/or messages sent through the Communication Channels.
11.4.2. When the User-Candidate schedules an interview with an applicant company, he undertakes to comply with the agreement by appearing at the interview. HCAI has the right to remove from the database and refuse future service to the User-Candidate who does not attend a meeting without notice or notification to the User-Employer.
11.4.3. Users are guaranteed the possibility of express solicitation to HCAI to change their data or content belonging to it, pursuant to Item 11.1.12 of these Terms.
11.4.4. By submitting content to any public area or on the site, including bulletin boards, forums, social networks and chat rooms, Users grant HCAI and its affiliates, free of charge, irrevocable, transferable (to third parties), and not exclusive (including any moral rights) a license to use, reproduce, modify, adapt, publish, translate, distribute, communicate to the public, perform and display such content (in whole or in part) anywhere.
11.5. Prohibited Practices
11.5.1. Users accept and undertake to use the Services without:
(a) Violation of these Terms and Conditions of Use and any other provisions relating to the use of the Services; And
(b) Violation of any law or rule in force in the Brazilian legal system.
11.6. Exclusions of Responsibilities
11.6.1. Users expressly acknowledge that HCAI, by only facilitating the approximation between candidates and employers, is not responsible for issues intrinsic to the characteristics of the advertised vacancies, the characteristics and/or hiring of Users, which includes, but is not limited to:
(a) Completeness, veracity, accuracy or reliability of the information of vacancies and/or curricula advertised on the Website and/or the App;
(b) the ability of companies to offer job opportunities to applicants and/or the inability of applicants to fill vacancies;
(c) behaviour of candidates in interviews or employment relationships; Or
(d) Indemnification or reparations for damages suffered by the User due to the contracts.
11.6.2. HCAI is expressly guaranteed the right of return if HCAI is to bear any reparation for Item 11.6.1 above.
11.6.3. HCAI does not confirm or warrant, expressly or implicitly, with respect to any aspect, including merchantability, suitability, originality, compatibility or results arising from the use of the Services for a particular use or purpose or that the operation of the Services will be uninterrupted and error-free.
11.6.4. In no event shall the amount of damage owed by either party include, and neither party shall be liable for, any lost profits or indirect damages, or for damages caused to third parties, subject to the other provisions set forth in these Terms and Conditions of Use, even if such Party has been advised of the possibility of such damages in advance.
12.2. HCAI may suspend the User registration when the use of the Services violates any condition set out in these Terms or other provision relating to the use of the Services.
